Delay Analysis and Litigation

Things change, and in Construction, things change a lot!

Projects rarely, if ever, get built exactly to the original plans.  There are often any number of unforeseen issues and events that can have major impact on the planned execution of the project, and very often these issues and events create delays or additional work.  These events often result in a claim for an Extension of Time in order to cope with the changes and carry out any additional works.

These claims are often contentious, and a source of conflict.  Whether your claim for an extension is successful, comes down to how well or otherwise, you can present and illustrate the effects that these changes have imposed on your programme.

Winning the argument comes down to proving the effect on the programme’s critical path.  Our team of expert programmers can precisely analyse the events surrounding the extension claim, quantify the effect on programme, and then illustrate the effect in a way that proves the validity of your claim.

When the parties to the contract really can’t agree, and the issue is referred to Remediation or Adjudication, we can help.  We can provide detailed evidential delay analysis using Critical Path Method and one or more of the various other approaches as prescribed in the Society of Construction Law - Delay and Disruption Protocol, such as:

  • Impacted As-Planned Analysis
  • Time Impact Analysis
  • Time Slice Windows Analysis
  • As-Planned versus As-Built Windows Analysis
  • Retrospective Longest Path Analysis
  • Collapsed As-Built Analysis
